Parekh & Co. has been involved in various high profile international and domestic arbitrations including institutional and ad hoc arbitrations.
The firm has appeared in a large number of construction contracts both for Contractors, Concessionaires, Engineers and Employers. We have appeared in Oil & Natural Gas arbitration, Power Sector arbitrations, Admiralty arbitrations as also arbitration relating to Commercial Disputes and contracts.
The firm has substantial experience and expertise in pre-arbitration processes including preparing correspondences, sending notices of dispute, notices of arbitration, appearing before Engineer, DRB, Mediators and Conciliators. The firm has been able to complete a number of simple and complex arbitrations in record time, including some in just three hearings or in a few months’ time.
The firm is well-equipped and proficient at handling in-house the entire gamut of all the necessary legal work relating to an arbitration, including preparation of Statements of claim, cross-examining witnesses and appearing for parties.
The firm regularly appears in numerous arbitrations for most of the leading construction companies and joint ventures including M/s Reliance Industries Ltd., Tata Projects Ltd., Larsen and Toubro, Hindustan Construction Company along with their various subsidiaries/arms. The firm therefore has expertise in various technical as well as legal aspects of advisory work as well as arbitrations relating to large infrastructure projects.
The firm has also been active in admiralty arbitrations and has appeared for various shipping entities and P&I Clubs. Dealing with arbitrations involving other Contractual disputes, it has appeared for clients such as Angang (a Chinese public sector company), Cormorant Limited, Nelco, Sahyag Nurseries etc. It appeared successfully for Nalco (a Government Sector Company) against Alcan Trading Company in an ICC Arbitration. It is currently appearing in a large number of domestic and international arbitrations all over India. It has also appeared for various governmental bodies for important domestic and international arbitrations including those for the National Highways Authority of India.
The Firm also handles litigation pertaining to arbitration, such as approaching courts for interim relief, appointment of arbitrator(s) etc. It has appeared before five-judge Bench of the Supreme Court for decision on an important issue regarding court supervision of arbitrations held abroad.
Partners of the firm have been appointed as Arbitrators. The firm has also been appointed by the Engineer to render decisions on its behalf. The firm has capacity to handle prima vera project planning software, preparing delay analysis reports and dealing with complex engineering issues.
The Firm has represented or is representing Reliance Industries in their various arbitrations with claim values from USD 3 Billion to over USD 33 billion. It has successfully represented Tata Projects in various arbitrations against SAIL, NMDC, DFCCIL, ONGC etc.
It has represented L&T against NTPC, Puri Construction, NHPC, DFCCIL. It has or is representing GMR, Nalco, RBM, PATI, Toshiba, Mitsui, Maeda, Kumagai, Impregilo etc. in various arbitrations.
